Review of Decisions

If you are not satisfied with any decision relating to a Right to Information access or amendment application, you can ask for a review of that decision.

Option 1 – Request an internal review

You can apply to Council for an internal review. This will be a review of the original decision. You must apply within 20 business days after the date of the written decision notice. 

A person who is not less senior than the original decision-maker will review your application. They will advise you of the review decision no later than 20 business days after the internal review application is made. This period will automatically be extended by 5 business days if you have only provided a postal address. The period for review may also be subject to an extension of time if requested by Council, or consultation with a third party is required. 

Reasons will be given if access or amendment is still refused.

Option 2 – request an external review

You may wish to request an external review of either: 

  • Council's original decision, or 

  • Council's internal review decision. 

You must apply directly to the Office of the Information Commissioner for an external review of a Council decision. You must apply within 20 business days after the date of the written decision notice. 

The Information Commissioner may change or confirm the decision made on your application or try to mediate a settlement between the parties.
